EUROSOL provides its Internal Information System (SII), in accordance with Law 2/2023, of February 20, for the protection of persons who report on regulatory infringements and corruption.

The SII is the official channel for reporting actions or omissions that may constitute serious legal or administrative infringements related to EUROSOL’s activity.

Objectives of the SII:

• Promote a culture of information to prevent criminal risks.

• Legally protect those who report and may suffer retaliation.

Matters that can be communicated

The following can be reported through the SII

National infringements

• Criminal or serious administrative offenses.
• Fraud against the Public Treasury or Social Security.

European infringements (EU Directive 2019/1937)

• Public procurement
• Financial markets and anti-money laundering
• Product safety and transport
• Environment and nuclear safety
• Animal health and public health
• Data protection and cybersecurity
• Competition, state aid, taxation

Internally

• Breaches of the Code of Ethics
• Violations of the Criminal Risk Prevention Plan

Who can use the channel?

The SII is available to people with a working or professional relationship with EUROSOL, including:

  • Internal staff and freelancers
  • Shareholders and members of governing bodies
  • Volunteers, interns and trainees
  • Candidates in selection processes
  • Staff of contractors, subcontractors and suppliers

Those who communicate outside the legal scope or without a relationship with EUROSOL will not be protected by Law 2/2023.

External channels

What the SII does not cover

This channel is not intended for:

  • General complaints or suggestions
  • Communications outside the legal scope of the SII
  • Complaints made in bad faith or with false facts

SII

In accordance with the entry into force of Law 2/2023, of February 20, regulating the protection of persons who report on regulatory infringements and the fight against corruption, EUROSOL makes available to you this Internal Information System (IIS), hereinafter, the IIS.

It is the appropriate communication channel to receive information on actions or omissions that fall within the material scope of application of Law 2/2023, of February 20, and that are related to the activity and operation of EUROSOL.

In this way, the IIS pursues the following objectives:

  • Promote a culture of reporting and information to prevent and detect criminal risks or serious or very serious administrative offenses within EUROSOL.

  • Legally protect those who report any of the infractions provided for in the regulations and who, as a result, may suffer reprisals within EUROSOL.

The issues or matters that can be reported through the IIS are:

  • Actions or omissions that may constitute a criminal offense or a serious or very serious administrative offense, including in any case those that imply economic damage to the Public Treasury and Social Security.

  • Actions or omissions that may constitute an infringement of specific European regulations included in the Annex of Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report on infringements of Union law, and which refers to matters of:

    • Public procurement.

    • Financial services, products and markets, and prevention of money laundering and terrorist financing.

    • Product safety and compliance.

    • Transport safety.

    • Environmental protection.

    • Protection against radiation and nuclear safety.

    • Food and feed safety, animal health and animal welfare.

    • Public health.

    • Consumer protection.

    • Protection of privacy and personal data, and security of networks and information systems.

    • Infringements affecting the European internal market (competition, state aid, tax benefits, corporate tax infringements, etc.).

Likewise, breaches or infringements of our Code of Ethics and the Criminal Risk Prevention Plan, as well as its policies and procedures, may also be subject to complaint or communication.

All those people who have labor or professional ties with EUROSOL may report, regardless of whether said relationship has ended, including in any case:

  1. EUROSOL staff and independent contractors.

  2. Shareholders, members of its governing, management or supervisory bodies, including non-executive members.

  3. Volunteers, interns or workers in training periods, regardless of whether they receive remuneration or not.

  4. People in selection or pre-contractual negotiation processes who have obtained the information during said processes.

  5. Any person who works for, or under the supervision and direction of, contractors, subcontractors and suppliers.

All those people who are not within this subjective scope, or those who, being authorized to use the channel, report on actions or omissions not included in the matters described in Law 2/2023, will not enjoy the protection provided therein.

On the other hand, it should be clarified that the purpose of this channel is not to manage complaints or suggestions, nor any other circumstance that is not related to the scope of the IIS. For these matters, EUROSOL makes different communication channels available to you.

Finally, any use of the IIS contrary to good faith or the communication of false facts through the channel will not be admitted for processing, without prejudice to the corresponding measures that EUROSOL may adopt.

EUROSOL has approved the Information Management and Processing Procedure for complaints, in order to regulate, in accordance with legal requirements, the competence of the Body Responsible for the System. The essential principles of said procedure are:

  • Expressly prohibit any type of reprisal adopted against people who use the IIS within its material and subjective scope.

  • Guarantee both the confidentiality or, where appropriate, the anonymity of the informant, as well as the confidentiality of the people affected by the complaint.

  • Allow the informant to maintain communication with the System Manager, as well as provide additional information, provided they have not waived their right to follow-up.

  • Right to the presumption of innocence, honor, defense and hearing of the affected people.

  • Respect and compliance with the regulations regarding the processing of personal data.

  • The System Manager must resolve the matter within a maximum period of three months from receipt of the complaint, except in cases of special complexity.

Likewise, if you wish, you can use the external information channels made available by the Independent Authority for the Protection of the Informant.
